JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 493 of the Indian Penal Code.
Petitioner happens to be husband of the informant, who claimed that she was badly assaulted by the petitioner by Lathi and Danda and petitioner made attempt to commit her murder by pressing her neck but from perusal of impugned order, I find that no injury report was produced by the prosecution.
Learned counsel appearing for the petitioner submits that, as a matter of fact, there was marital discord between the
Patna High Court CR. MISC. No.24645 of 2019(2) dt.18-04-2019 2/2 petitioner and his wife and the present case is outcome of bad matrimonial life. It is further submitted that the petitioner is in jail custody since 06.01.2019.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhagalpur in conneciton with Nath Nagar (Lalmatia) P. S. Case No. 13 of 2019.
