2. This is a case of misuse of bail. Earlier the prayer of the petitioner for regular bail was allowed vide Cr. Misc. No. 27713 of 2023 on 15.05.2023.
3. The petitioner seeks regular bail in connection with Excise P.S. Case No. 47C2 of 2023 registered for the offence under Section 37(1) of the Bihar Prohibition and Excise Amendment Act.
4. The learned counsel for the petitioner has submitted that the witnesses are being examined in the trial. The petitioner is in custody since 06.12.2024.
5. Considering the facts and circumstances of the case, this application for regular bail is allowed.

Accordingly, let the petitioner, above named, be released after framing of charge if the charge has not already been framed on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cumExclusive Special Court No. 2nd Excise Act, Lakhisarai/concerned Court below in connection with Excise P.S. Case No. 47C2 of 2023 subject to condition that:- (i). The petitioner shall appear in the trial regularly on each and every date on which the witnesses are being produced by the prosecution either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bonds of the petitioner.
