JUSTICE PRABHAT KUMAR JHA ORAL ORDER 16-09-2016 Learned counsel for the petitioners seeks permission to withdraw the anticipatory bail petition of Petitioner no. 2 Nanhak Mahto @ Manhaku Mahto and Petitioner no. 3 Bhim Mahto.

Accordingly, the anticipatory bail petition of petitioner nos. 2 and 3 is dismissed as withdrawn. Heard both sides.

The petitioner Samita Devi apprehends her arrest in Marhaura P.S. Case No. 01 of 2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.

The informant alleged that her daughter was coming

Patna High Court Cr.Misc. No.39335 of 2016 (2) dt.16-09-2016 2/2 after taking tuition but Nanhak Mahto dashed her daughter. When her daughter asked the reason for dashing her, the accused persons abused her and thereafter they assaulted the informant and others. It is submitted that no specific allegation of assault is made against the petitioner Samita Devi.

Considering the facts aforesaid and the fact that the petitioner is a lady, the petitioner Samita Devi above named in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Saran at Chapra in connection with Marhaura P.S. Case No. 01 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
