The petitioner seeks bail in Wajirganj P.S. Case No. 274 of 2020, registered for the offence under Sections 307, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the F.I.R., this petitioner alongwith other F.I.R. named accused persons got the son of informant shot by hiring the professional criminals.

It is submitted on behalf of petitioner that due to land dispute between the parties, the petitioner has been falsely implicated in this case and during course of investigation, the victim in paragraph - 29 of the case diary has clearly stated that due to darkness, he could not identify anybody. Even, as per F.I.R., petitioner is not the assailant. Petitioner is in custody since 07.07.2020.

Patna High Court CR. MISC. No.37254 of 2021(5) dt.25-01-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Gaya in connection with Wajirganj P.S. Case No. 274 of 2020.
