The petitioner apprehends his arrest in connection with Basnahi P. S. Case No. 67 of 2015 instituted under Sections 364/34 of the Indian Penal Code.

The allegation, in brief, is that the informant's son and daughter-in-law went somewhere along with Alok Yadav @ Premlal Yadav (the petitioner) along with three other unknown persons and thereafter did not return back and it is suspected by the informant that the son and daughter-in-law have been eliminated.

Learned counsel for the petitioner submits that Biram Devi earlier married to some other person and she was kidnapped by the son of the informant, namely, Binod Yadav and this petitioner has no concern.

No.42422 of 2016 (4) dt.06-02-2017 2/2 It appears that still so called victims are traceless and as per allegation, they had gone along with the petitioner and thereafter did not return back. So this court is not inclined to admit the petitioner on anticipatory bail. The prayer for anticipatory bail of the petitioner is rejected.

However, the petitioner, if so advised, surrenders before the learned court below and prays for regular bail, the same shall be considered on its own merit without being prejudiced by this order.
