JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-02-2018 Petitioners apprehend their arrest in connection with Mohania P.S.Case No. 569 of 2017 registered for the offences under Sections 341, 323, 307, 325, 384, 506 and 34 of the Indian Penal Code.
Allegation against the petitioner is of assault to the informant and other family members.
Submission of learned counsel for the petitioners is that though there is allegation of assault by sword but there is no such injury and further petitioner No.1 is about 75 years old and further there is land dispute between the parties from before. Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail but

In the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Mohania P.S. Case No. 569 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioners will co-operate in investigation and will appear before the Investigating Officer as and when required, except on genuine reason, failing which their bail bonds shall be cancelled.
