The petitioner is a holder of licence bearing No.67 of 2007 issued under the Public Distribution System (Control) Oder, 2001 as enforced in the State of Bihar vide Fair Price Shop Order, 2007 (hereinafter referred to as 'the Control Order'). The licence of the petitioner has been cancelled on grounds of irregularities under the orders of the Licensing Authority -cum- Sub-Divisional Officer, Marhowrah, districtSaran vide order bearing Memo No.2410 dated 12.7.2013 placed at Annexure-5. The petitioner being aggrieved has preferred statutory appeal under Clause-15 of 'the Control Order' before the District Magistrate -cum-Collector, Saran at Chapra bearing

Patna High Court CWJC No.16518 of 2014 (2) dt.08-05-2015 Supply Appeal No.37 of 2013 and the grievance of the petitioner is that despite a period of almost two years having lapsed the appeal is yet to be disposed of.

Having heard learned counsel for the parties and considering the limited grievance raised by the petitioner, the writ petition is disposed of with a direction to the District Magistrate -cum- Collector, Saran at Chapra to consider and dispose of the Supply Appeal No.37 of 2013 in accordance with law and after giving opportunity of hearing to the petitioner expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order.
