Although the writ petition is directed against the notice issued by the Nalanda District Central Cooperative Bank impugned at Annexure-2 but Mr. Sanjay Kumar, learned counsel for the petitioner appreciating his difficulty has by modifying the relief sought a direction to the District Manager, Bihar State Food and Civil Supplies Corporation, Nalanda at Biharsharif to consider his grievance regarding the outstanding pending for payment with the Corporation as reflected in his representation dated 28.7.2014
Patna High Court CWJC No.18350 of 2014 (3) dt.09-02-2016 2/2 present at Anneuxre-3 and for its disposal.
Having heard learned counsel for the parties and considering the reasonable prayer made by Mr. Kumar, this Court while modifying the relief prayed by the petitioner disposes of the writ petition with the direction to the District Manager, Bihar State Food and Civil Supplies Corporation, Nalanda at Biharsharif to consider the claim advanced by the petitioner as reflected in the writ petition present at Annexure-3 and in case it is found that a sum of Rs. 8,65,032.93 remains outstanding for payment to the petitioner in respect of the paddy supplied during the Khariff Season 2013-14, the same may be paid to him expeditiously and preferably within 6 weeks of the receipt/production of a copy of the order and in case for any reason the same is not found acceptable, the claim may be disposed of by speaking order to be passed within the same period.
The writ petition is disposed of.
