The petitioner seeks regular bail in connection with Imamganj Police Station Case No. 227 of 2019, registered for the offence punishable under Section 414 of the Indian Penal Code.

The allegation against the petitioner, as per the First Information Report, is that the police, on the basis of secret information, raided the house of the petitioner and recovered one stolen passion pro motorcycle from the cow-shed of the petitioner.

Learned Counsel for the petitioner submits that the

He further submits that the petitioner has got no criminal antecedent and the alleged motorcycle was not recovered from the conscious possession of the petitioner and the same was recovered from the cow-shed, situated outside the house of the petitioner, which is an open space, accessible to all and sundry. He further submits that the petitioner is in custody since 27.12.2019.

After having heard learned Counsel for the parties and taking into consideration the materials on record and the fact that the petitioner has got no criminal antecedent and he is in custody since 27.12.2019, I am inclined to grant regular bail to the petitioner.

This application is allowed.

Accordingly, let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sherghati, Gaya, in connection with Imamganj Police Station Case No. 227 of 2019.
