This application for grant of anticipatory bail arises out of Bikram P.S. Case No. 87 of 2014, disclosing offences under Sections 379 and 411 of the Indian Penal Code. Iron grill of stair of Sridharasram High School, Bagha Kol (Patut), Patna was allegedly stolen and subsequently found in possession of one Birendra Kumar Sony. He is said to have named the petitioner who had sold the stolen iron grills to him. Learned counsel for the petitioner submits that only on the basis of statement of said Birendra Kumar Sony, the petitioner has been implicated and there is no other material against him. Considering the submission and the fact as stated in

Patna High Court Cr.Misc. No.58293 of 2015 (2) dt.01-02-2016 2/2 paragraph 3 of the application that the petitioner has no criminal antecedent, this application is allowed.

Let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Danapur in connection with Bikram P.S. Case No. 87 of 2014, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
