This application for grant of anticipatory bail arises out of Kudra P.S. Case No.182 of 2014, disclosing offences under Sections 409 and 420 of the Indian Penal Code.

The petitioner, a Probationary Officer in the

Patna High Court Cr.Misc. No.58254 of 2015 (2) dt.01-02-2016 2/3 Bank of Baroda, was, at the relevant point of time, InCharge Manager of Kudra Branch of the said Bank. The allegation, based on the complaint petition, is that a sum of Rs.50,000/- came to be fraudulently withdrawn from the informant's account. It is alleged that the petitioner had identified the thumb impression of the drawee. Learned counsel, appearing on behalf of the petitioner, has submitted that the petitioner had nearly one and half months of experience, as a Bank Officer, at the relevant point of time and he has been made a scapegoat. He further submits that the dispute between the parties has since been resolved amicably. Considering the submission, as above, this application is allowed.

Let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabhua (Kaimur), in connection with Kudra P.S. Case No.182 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as
