JUSTICE BIRENDRA KUMAR ORAL ORDER 05-02-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Durgawati P.S. Case No.162 of 2019, registered for the offence punishable under Section 304B/34 of the Indian Penal Code.

Wife of the petitioner died in unnatural circumstance in the house of the petitioner within five years of her marriage and allegation is of demand of dowry and torture for the same soon before death.

Learned counsel for the petitioner submits that for trivial dispute between the husband and wife, wife has committed suicide.

Considering the nature of allegation against the

Patna High Court CR. MISC. No.27773 of 2020(4) dt.05-02-2021 2/2 petitioner and supporting material brought on the record during investigation of the case, I am not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail is refused. Petitioner is directed to surrender within two weeks and pray for regular bail.
