JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Raghopur P.S. Case No. 45 of 2015, disclosing offences under Sections 147,148,283,120B, 341,323,353,431 and 504 of the Indian Penal Code.

Learned counsel for the petitioner appears to be right in his submission that the case of the petitioner is identical with those who had been granted the privilege of anticipatory bail by orders dated, 05.08.2015, 07.10.2015 and 14.10.2015 passed in Cr. Misc. No. 31756 of 2015, Cr. Misc. No. 41143 of 2015 and Cr. Misc. No. 42946 of 2015.

In view of the submissions as above, this application is

Patna High Court Cr.Misc. No.58147 of 2015 (3) dt.01-02-2016 allowed.

Let the petitioner above-named, in the event of his arrest/surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Birpur ( Supaul) in connection with Raghopur P.S. Case No. 45 of 2015, subject to the conditions as laid down under Section 438 of the Cr.P.C.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
