JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kateya P.S. Case No. 59 of 2017, registered under Sections 341, 323, 354, 307, 379, 504 and 447/34 of the Indian Penal Code and Section 7/8 of the POCSO Act.

The accusation is that, on 18.03.2017, at about 11 A.M., the petitioner entered in the house of the informant and tried to outrage the modesty of his daughter, Manisha Kumari. On raising alarm, villagers came there then petitioner fled away. On complaint made by the informant, villagers fixed Panchayati. In the meantime, his daughter was going to Bathan then Bira Singh caused injury at her head through Farsa.

Patna High Court Cr.Misc. No.42421 of 2017 (2) dt.20-09-2017 Learned counsel for the petitioner submits that, in fact, occurrence took place in between the family of the petitioner and the informant, in which, mother of the petitioner sustained injury, whose statement was recorded on 19.03.2017 at Sadar Hospital, Gopalganj, on which basis, Kateya P.S. Case No. 64 of 2017 was instituted due to that reason the informant has lodged the present case only to give undue pressure.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Ist Additional Sessions Judge-cumSpecial Judge, Gopalganj, in connection with Kateya P.S. Case No. 59 of 2017/ Trial No. 07 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
