JUSTICE ARVIND SRIVASTAVA ORAL ORDER 23-11-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Falka Police Station Case No. 100 of 2014, disclosing offences under Section 364 of the Indian Penal Code. Learned counsel for the petitioners has submitted that the petitioners happen to be family members of petitioner no.4, who is daughter-n-law of the informant, have falsely been
Patna High Court Cr.Misc. No.44958 of 2017 (3) dt.23-11-2017 implicated in this. In fact, the son of the informant has kidnapped a minor girl and fled away along with her for which Dhamdaha P.S. Case No. 142 of 2014 has been instituted, which is evident from annexure-2. As a matter of fact, petitioner no.4 happens to be daughter-in-law of the informant and she has also filed maintenance and complaint case against the son of the informant, which is evident from annexure-3. Hence, the petitioners who are of clean antecedent deserve the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Falka Police Station Case No. 100 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
