This application, for grant of anticipatory bail, arises out of Angarghat Police Station Case No. 72 of 2017, disclosing offences under Sections 447, 504, 323, 307, 379 and 34 of the Indian Penal Code.
Learned Counsel for the petitioner has submitted that there is general and omnibus allegation against this petitioner and no specific overt act is attributed to him. In fact, the occurrence took place on 21.08.2017 whereas the F.I.R. has been lodged after lapse of 9 days without explaining the plausible delay. The main allegation of assault on the head of the informant is attributed to co-accused Deo Nandan Singh. The
Patna High Court Cr.Misc. No.21668 of 2018 (2) dt.30-04-2018 petitioner has not no criminal antecedent. Hence, the petitioner also deserves the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Dalsingsarai (Samastipur), in connection with Angarghat Police Station Case No. 72 of 2017/ G.R. No. 592 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
