2. This is an application for cancellation of regular bail granted to opposite party No. 2 by co-ordinate Bench of this Court vide order dated 11.01.2018 passed in Cr. Misc. No. 54054 of 2017.

3. Learned counsel for the opposite party No. 2 filed supplementary counter affidavit stating therein that opposite party No. 2 is in a very pitiable condition though any how he managed Rs. 1 lac and is ready to pay the same to the petitioner vide Demand Draft No. 401272 dated 28.07.2023 issued from the Bank of Baroda, Sasaram Branch which is being handed over to the opposite party No. 2 in the

Patna High Court CR. MISC. No.39278 of 2019(9) dt.02-08-2023 2/2 Court. He further undertakes that opposite party No. 2 will pay the remaining amount of Rs. 9 lacs to the petitioner within a period of two years.

4. Considering the aforesaid facts and circumstances of the case, the present petition is disposed of granting liberty to the petitioner to move before the learned court below and pray for cancellation of bail of the opposite party No. 2 if the said remaining amount of Rs. 9 lacs is not paid to him by the opposite party No. 2 within a period of two years from the production/receipt of copy of this order.
