The petitioner is apprehending his arrest in connection with Jadia P.S.Case No.107 of 2016, registered for offences punishable under Sections 409 of the Indian Penal Code.

Allegation against the petitoner is that he was Panchayat Sevak and being a Panchayat Sevak he has not handed over the relevant documents related to appointment of Panchayat Teachers. Submission of the learned counsel for the petitioner is that he was Panchayat Sevak of Koriyapatti East and for some time he was incharge of Koriyapatti West also but he has not made available the relevant documents, about which he has informed to the Block Development Officer also and in spite of that he has been made accused in this case.

Patna High Court Cr.Misc. No.38475 of 2017 (2) dt.21-08-2017 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction that let the petitioner surrender within a period of four weeks and thereafter he shall be released on provisional bail in connection with Jadia P.S.Case No.107 of 2016 to the satisfaction of C.J.M., Supaul on bail bond of Rs.25,000/- (Twenty Five Thousand) till submission of the charge-sheet and once the charge-sheet is submitted against the petitioner, he will move for regular bail, which will be considered by the learned court below on the basis of materials available against him without being prejudiced by the order of this Court.

With the aforesaid observation, this application is disposed of.
