The petitioner apprehends his arrest in Rasulpur P.S. case No. 17 of 2017 for the offences punishable under Section 307 and other Sections of the Indian Penal Code.
The informant alleged that some dispute arose for removal of generator from the road, which was creating nuisance, but the generator was removed. The petitioner is alleged to have assaulted the nephew of the informant with Farsa on his head. The learned counsel for the petitioner submits that there is, admittedly, land dispute between the parties. The nephew of the informant, as appears from Annexure-3, got lacerated wound which is superficial and simple in nature. No injury was found on the body of nephew of informant said to have been

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-X, Saran at Chapra in connection with Rasulpur P.S. case No.17 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
