JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the complainant. The petitioner seeks pre-arrest bail in connection with Complaint Case No. 775 (c) of 2015 in which cognizance has been taken under Sections 406, 504 and 323 of the Indian Penal Code.

It is contended that instant case is of civil nature relating to dispute regarding interest and money claim. Learned counsel for the complainant has opposed the

Patna High Court Cr.Misc. No.2691 of 2016 (3) dt.12-04-2016 2/2 prayer for grant of pre-arrest bail to the petitioner. He has contended that though the petitioner being his grandson had taken Rs.8,00,000/- from him in the name of doing business, he has returned only Rs.5,15,000/- till date and the remaining amount to the tune of Rs.2,85,000/- is still due against him. Regard being had to the nature of allegation, in the event of arrest or surrender before the court below within four weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in Complaint Case No. 775 (c) of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
