Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Barauni (Refindary) P.S. Case No. 451 of 2021 registered for the offence under Sections 392 of the Indian Penal Code. As per the F.I.R., the allegation was against unknown persons is that they snatched the key of informant's bike and the name of the petitioner has come on the confessional statement of the co-accused regarding his involvement in the said occurrence.

Patna High Court CR. MISC. No.29079 of 2023(2) dt.24-05-2023 2/2 Learned counsel for the petitioner submits that the petitioner is in custody since 16.06.2022 and the petitioner is quite innocent and has committed no offence.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Begusarai/concerned Court below in connection with Barauni P.S. Case No. 451 of 2021. The petitioner will mark his attendance at the Fulwariya Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
