The petitioner apprehends his arrest in connection with Siwan Mufassil (Dhanauti O.P.) P.S. Case No. 05 of 2019 registered under Sections 272, 273 of the Indian Penal Code and sections 30(a), 41(i) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that nothing has been recovered from the possession of the petitioner. Further he submits that on perusal of the seizure list, it appears that the alleged recovery has been made from the vehicle near the School and petitioner is not the owner of the vehicle in question.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in

No.25464 of 2019(2) dt.19-04-2019 2/2 the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-II-cum-Special Judge, Excise, Siwan in connection with Siwan Mufassil (Dhanauti O.P.) P.S. Case No. 05 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
