The petitioner apprehends his arrest in connection with Basantpur (Lakri Naviganj O.P.) P.S. Case No. 11 of 2021 registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and from perusal of the allegation as alleged in the F.I.R. it would manifest that the informant was assaulted by knife by co-accused Sadhu Yadav and as far as this petitioner is concerned, it is alleged that he was also present there and had caught the informant along with others.

No.36988 of 2021(2) dt.14-06-2022 2/2 Learned counsel for the petitioner submits that allegation of assault is against Sadhu of causing injury and as far as this petitioner is concerned, it is only alleged that he had caught the informant who had come to play cricket with him, it is next submitted that co-accused Salman, Harendra Prasad and Hareram Mahto have been granted regular bail by the learned court below.

At this stage, learned counsel for the petitioner seeks permission to withdraw the present anticipatory bail application. Permission is accorded.

Accordingly, the present anticipatory bail stands dismissed as withdrawn.

The learned court below is directed that if possible the case be disposed on the same day considering the submissions of the learned counsel for the petitioner that the co-accused have been granted regular bail by the learned court below. (Satyavrat Verma, J) Rishi/- U T
