JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 27-04-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Supaul P.S. Case No.465 of 2017 registered under Sections 302, 307, 323, 325, 341 and 504 read with 34 of the Indian Penal Code.

Considering the direct and specific allegation made in the first information report that the petitioners and others assaulted with lathi and danda to the husband of the informant as a result of which, he died, I am not inclined to grant them pre-arrest bail. Their application for bail is rejected.

Patna High Court Cr.Misc. No.22324 of 2018 (2) dt.27-04-2018 In case the petitioners surrender and seek bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
