Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420, 406, 129B)/ 34 of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have executed sale deed in favour of informant on 01.10.2018 on the basis of forged and fabricated papers. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that deed in question was executed in the year 2018 but this case has been lodged in the year 2022 and at the time of execution of sale deed entire document was shown to the informant and after fully satisfied with the same

Patna High Court CR. MISC. No.27362 of 2022(4) dt.05-12-2022 2/2 the informant purchased the land and he is still in possession of the same. The dispute is of civil nature and no offence is made out.

Learned counsel appearing for the State and the informant opposed the prayer for anticipatory bail and submitted that petitioner has got criminal antecedent of two cases.

In reply learned counsel for the petitioner submits that petitioner is on bail in those cases.

Considering the facts of the case and nature of accusation against the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Muffasil PS case No. 53/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C.
