JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 25-02-2015 The application seeks restoration of MJC No. 1438 of 2013 which stood dismissed for non compliance of the peremptory order dated 13.08.2014 whereby the petitioner was directed to take steps for fresh service of notice on opposite party no.9 with present and correct address for which requisites were to be filed within two weeks.

It appears from the averments made in the application that requisites were filed on 28.08.2014 just few days after expiry of time granted under order dated 13.08.2014. The petitioner has disclosed the reasons therefor in diverse paragraphs of the application.

In view of aforesaid, the application is allowed. The time granted under order dated 13.08.2014 passed in MJC No. 1438 of 2013 is extended to 28.08.2014.
