JUSTICE BIRENDRA KUMAR ORAL ORDER 09-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341,323,307,504/34 of the Indian Penal Code and Section 47(a) of the Excise Act.
The petitioners allegedly committed assault to the informant as he asked them not to carry the business of spirit in his premises.
Submission is that due to land dispute false case has been instituted.
Patna High Court Cr.Misc. No.48924 of 2016 (2) dt.09-12-2016 Considering the facts and circumstances of the case, let, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari/Successor Court in connection with Pipra P.S. Case No. 135 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
