JUSTICE ARVIND SRIVASTAVA ORAL ORDER 02-11-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Sasaram (Tilauthu) P.S. Case No. 783 of 2016 registered for the offence punishable under sections 406, 420/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this present case. As a matter of fact, he has no concern with the informant rather on advise of other co-accused persons only the amount was deposited in the account of the petitioner and was thereafter withdrawn. With regard to the money in question, there is an agreement between the other co-accused persons and the informant and petitioner has no role in that. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case and the
Patna High Court Cr.Misc. No.43903 of 2017(3) dt.02-11-2017 2/2 submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Tilauthu) P.S. Case No. 783 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
