====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 05-07-2024 Heard learned counsel for the Petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Rampur P.S. Case No. 373 of 2022 dated 21.07.2022 registered for the offences punishable under Sections 413 and 414 read with section 34 of the Indian Penal Code.

3. Mr. Praveen Kumar, learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case and his name transpired on the basis of confessional statement of co-accused, namely, Bharat Kumar, who has been granted bail by this Bench vide order dated 20.03.2023 passed in Cr. Misc. No. 61836 of 2022. Learned counsel further submits that no any incriminating material has been recovered from the possession of this

Patna High Court CR. MISC. No.30577 of 2024(2) dt.05-07-2024 2/2 petitioner and he has been languishing in jail since 10.02.2024, having fair and clean antecedent and against him, the investigation has been completed.

4. Mrs. Asha Kumari, learned APP appearing for the State has opposed the prayer for bail of the petitioner.

5. Having regard to the afore-mentioned submissions and petitioner's custody period and also, his fair and clean antecedent, in the opinion of this Court, the petitioner deserves to the privilege of bail. Accordingly, let the petitioner namedabove be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Rampur P.S. Case No. 373 of 2022.
