The petitioner seeks regular bail in connection with Parasbigha P.S. Case No. 96 of 2019 for the offence registered under Sections 147, 148, 149, 341, 323, 504, 506, 353 and 307 of the Indian Penal Code.
The allegation is regarding several persons having formed unlawful assembly at the alleged place and time of occurrence and had also blocked the road by putting wood logs and cot etc. on the road on account of a co-villager having died on account of injuries sustained during the course of road accident. It is further alleged by the informant that when the Police and S.S.B. team had tried to pacify the protesters, the villagers/protesters had started pelting bricks etc. resulting in the police force having received injuries.

No.27859 of 2020(2) dt.04-11-2020 2/2 The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case and is having a clean antecedent. It is further submitted that a general and omnibus allegation has been levelled against the accused persons, hence the petitioner be granted the privilege of bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the fact that a general and omnibus allegation of assault has been levelled against the mob in question, I deem it fit and proper to direct for release of the petitioner herein on regular bail.
Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Parasbigha P.S.
