Petitioner is an accused in connection with 374 of 2018 corresponding to G.R. No. 2927 of 2018 for the offence registered under Sections 363, 366(A), 379 and 376/34 of the Indian Penal Code and Section 4 of the POCSO Act. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the instant case. It is further submitted that the First information report has been lodged after 10 days. It is further submitted that the victim girl in her statement under Section 164 Cr. PC has stated that she voluntarily came in the company of the petitioner due to love affairs. It is further submitted that the petitioner has no criminal antecedent and he is in custody since 16.03.2020.
