The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 467, 468, 471, 420, 409, 120B of the Indian Penal Code. It is submitted by learned counsel for the petitioner that petitioner is innocent, not named in the FIR and has been falsely implicated in this case. He submits that petitioner's name transpired during course of investigation. He submits that petitioner is an employee of the Nagar Parishad, Chapra and has been made a scapegoat due to department politics. During course of investigation, Prasoon Trivedi himself stated that he got the account of Manoj opened in the Bank after asking the Branch Manager as Manoj was being seen with the petitioner usually in the Bank. He submits that from perusal of
Patna High Court CR. MISC. No.37244 of 2021(4) dt.21-03-2022 2/2 para-60 of the case dairy, it transpires that one Sunita Devi is the identifier of the petitioner's application in the Bank. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.
Learned APP for the State opposed the prayer for bail.
Considering the facts and circumstances of the case and the fact that there is no specific overt act against the petitioner, the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Chapra Town P.S. Case No. 119 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
