2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 346, 367, 370, 370(A), 372, 373, 376, 120(B)/34 of the Indian Penal Code, Sections 4, 6, 12, 17 of the Protection of Children from Sexual Offences Act, Sections 3, 4, 5, 6 of the Immoral Traffic (Prevention) Act and Sections 75, 79 of the Juvenile Justice Act.
3. It is alleged that all the F.I.R. named accused persons including this petitioner were involved in trafficking of children and on raid, one minor girl was recovered from the house of one Nazma Khatoon.
4. It is submitted that specific accusation is against coaccused Nazma Khatoon and petitioner is only alleged to be
Patna High Court CR. MISC. No.33017 of 2024(3) dt.02-07-2024 2/2 associate of co-accused Nazma Khatoon. It is next submitted that the victim in her statement has not alleged any wrong against this petitioner. Petitioner claims clean antecedent.
5. Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of VIth Additional Sessions Judge cum Special Judge (POCSO Act), Purnea in connection with K. Hat (Maranga) P. S. Case No. 1419 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
