====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 23-09-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 420, 409 of the I.P.C. According to FIR, the petitioner being junior engineer certified the completion of work though the work was of inferior quality and in collusion with other accused including Mukhiya public money was withdrawn.

Learned counsel for the petitioner submits that the petitioner is in custody since 17.03.2021. Petitioner has got no criminal antecedent. There is no direct role of the petitioner in withdrawal of the money.

Considering the responsibility assigned to the petitioner and his deliberate act in submitting a report of perfect

Hence, prayer for bail is refused in connection with Ladaniya P.S. Case No. 183 of 2019 pending in the court of learned Judicial Magistrate 1st Class, Madhubani.
