The petitioners being the parents of the husband of the complainant are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under sections 498A and 4 of the Dowry Prohibition Act.
Basic accusation is of torture for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioners that the accusation is omnibus and general against the entire inlaws family including the petitioners. Moreover, the thrust of accusation is against the husband of the complainant.
Patna High Court Cr.Misc. No.42670 of 2016 (2) dt.28-09-2016 2/2 The learned Sessions Judge disposed of the anticipatory bail application of the petitioners since only summons have been issued.
Learned counsel for the petitioners submits that till date only summons have been issued.
In view of the nature of accusation and till date only summons have been issued, it is a case for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Complaint Case No.2334C/2015, pending before the learned SDJM, Begusarai. With the above observation, this application is, accordingly, disposed off in view of the ratio laid down in the case of Abinash Kumar @ Avinash Kumar @ Pappu Vs. State of Bihar & Anr reported in 2016(1) PLJR 575 (Criminal Miscellaneous No.9689 of 2015.
It is expected from the learned court below to dispose of the bail application of the petitioners preferably on the said day, (Dinesh Kumar Singh, J) Ashwini/- U T
