The petitioners apprehend their arrest in connection with Mahua P.S. Case No. 429 of 2018 registered under Sections 414/34 of the I.P.C. as well as Sections 30, 30(a) of the Bihar Prohibition and Excise Act, 2016 pending in the Court of 2nd Additional Sessions Judge-cum-Special Judge, Vaishali at Hajipur.

Submission is that petitioners are innocent and have falsely been implicated in the present case. Petitioners have no concern with the seized materials.

Learned A.P.P. appearing on behalf of the State

Patna High Court CR. MISC. No. 28482 of 2019(2) dt.01-05-2019 2/2 vehemently opposed the prayer of the petitioners by contending that the alleged recovery has been made from the possession of the petitioners. The seizure list reflects the recovery of huge quantity of IMFL from the house of the petitioners. Having considered the above facts and circumstances of the case as well as the recovery of huge quantity, I am not inclined to allow the prayer of the petitioners for anticipatory bail.
