JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-07-2019 This is an application for grant of anticipatory bail in connection with Chautarwa P.S. Case No. 303 of 2018, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Prosecution story is that police got a secret information that some persons are coming with liquor on motorcycle and thereafter, police saw a motorcycle is coming and on seeing the police party, one person succeeded in fleeing away and another arrested and there is recovery of 37.800 liters of illicit liquor along with mobile phone. It is also alleged that apprehended person disclosed the name of the petitioner. Submission of the learned counsel for the petitioner is that except the confessional statement of the co-accused, there is absolutely nothing against the petitioner and he has no criminal

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise West Champaran at Bettiah, in connection with Chautarwa P.S. Case No. 303 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
