JUSTICE SUDHIR SINGH ORAL ORDER 09-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Madanpur P.S.Case No. 51/2015 instituted under Sections 409 and 420 of the Indian Penal Code.

As per FIR the petitioner was deputed by the District Administration as Incharge of paddy purchase center Madanopur in the year 2011/12 where in all 891.854 Met. Tones paddy was purchased, out of which 871.664 Met. Tones paddy was supplied by the petitioner. There was shortage of 20.79 Met Tones paddy. The price of said paddy amount to Rs. 2,65,093/-. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He is a Revenue Karamchari. As per prosecution case, total paddy was purchased

Patna High Court Cr.Misc. No.58240 of 2015 (2) dt.09-03-2016 2/2 was 891.854 Met. Tones and supply was made of 871.664 Met. Tones and as such there was shortage of 20.79 Met. Tones, which is valued at Rs. 2,65,093/-. From perusal of Annexure it is evident that the said amount has already been deposited by the petitioner. On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Madanpur P.S.Case no. 51 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
