2. The petitioner apprehends his arrest in a case registered for the offence under Sections 409, 420 of the Indian Penal Code.
3. As per prosecution case, co-accused Sanjay Kumar, while working as Cashier in Punjab National Bank Branch of the informant, committed embezzlement of an amount of Rs. 55,33,901/- by a number of fraudulent transactions. Allegation against petitioner is that Rs. 30,000/- was also transferred in his account in the name of 'Indira Awas Yojana'.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case and has got no concern with co-accused Sanjay Kumar. However, without
Patna High Court CR. MISC. No.26229 of 2025(2) dt.08-05-2025 2/3 admitting the allegation made in the F.I.R., the petitioner is ready to deposit Rs. 30,000/- (Rupees thirty thousand) in the Nazarat of concerned Civil Court.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - III, Madhubani in connection with Ladaniya P.S. Case No. 135 of 2016, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further following conditions:
"(A) At the time of furnishing bail-bond, the petitioner shall deposit Rs. 30,000/- (Rupees thirty thousand) in the Nazarat of concerned Civil Court and receipt of the same shall be furnished with the bail-bond.
(B) The aforesaid payment shall be subject to final outcome of the case.
(C) If petitioner fails to comply the direction of this Court, the learned Court below would be at liberty to cancel the bail-bond of the petitioner."
6. This order has been passed, without going into the merit of the case, only for the purpose of considering the prayer
