====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-04-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Bahera P.S. Case No.522 of 2018 registered under Sections 143, 341, 323, 353, 384 and 504 of the Indian Penal Code. The accusation is that the informant got the contract work for the construction of Panchayat Sarkar Bhawan in village-Pohaddi. On 15.11.2018, when the informant started the construction work, the petitioners along with Lal Bihari Jha, two widows and two unknown came there and started to abuse the labourers, engaged in the work of construction, and started to stop the work and also made demand of ransom.

No.27093 of 2019(2) dt.29-04-2019 2/2 Learned counsel appearing on behalf of the petitioners submits that, in fact, for the construction work, the land, which was selected by the Circle Officer, is belonging to the petitioners regarding which the petitioner no.1 had filed Land Settlement Case No.24 of 2018 before the D.C.L.R., Benipur on 28.11.2018, due to that reason, the Circle Officer got instituted the present case against the petitioners. The petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Benipur, Darbhanga, in connection with Bahera P.S. Case No.522 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
