The challenge in the present writ application is to the age limit of 55 years, as a dependent of a P.D.S. Dealer is entitled to a licence on compassionate grounds only if the dealer has died before attaining the age of 55 years.

Such issue has been examined by a Division Bench of this Court in C.W.J.C. No. 15157 of 2011 (Bihar Pradesh Jan Bitran Pranali Dukandar Sangh Vs. The State of Bihar & Ors.) decided on 20th of December, 2013.
