JUSTICE JYOTI SARAN) 25-04-2019 Although the petitioner has been running around for removal of the encroachment but having done so he has not taken recourse to remedy available under the Bihar Public Land Encroachment Act, 1956(hereinafter referred to as 'the Act') before the respondent No.4, the Circle Officer, Lakhisarai, Block Lakhisarai for removal of encroachment under the provisions of 'the Act'.

In the circumstances, we can only permit the

Patna High Court CWJC No.8980 of 2019(2) dt.25-04-2019 2/2 petitioner to take recourse to the remedy so available under 'the Act' by filing duly constituted application by arraigning alleged encroachers and also explaining details encroachment and whereupon the Circle Officer shall proceed to dispose of the same after opportunity of hearing to the petitioner and well as the encroachers preferably within 6 months of filing of such application.

This disposes of this application.
