The petitioner apprehends his arrest in connection with Trial No. 1843 of 2016 arising out of Complaint Case No. 2723 of 2014 registered under Section 498A/34 of the I.P.C. pending in the Court of C.J.M., Motihari, East Champaran. Learned counsel for the petitioner submits that petitioner, who happens to be the husband, is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with submission

Patna High Court Cr.Misc. No.50266 of 2016 (5) dt.30-03-2017 2/2 that there is specific allegation of cruelty and harassment and petitioner has also got second marriage.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
