2. The accused/petitioner not named in FIR and apprehending his arrest in connection with Cyber P.S. Case No. 03 of 2026 registered for the offences punishable under Sections 303(2), 317(2), 317(4), 317(5), 318(4) of Bhartiya Nayay Sanhita and Section 66(C), 66(D) of IT Act.
3. As per FIR, some unknown persons committed cyber fraud upon the informant and by using UPI withdrawn illegally Rs. 82,000/-. A complaint was also lodged in this connection on help line No. 1930.
4. It is submitted by learned counsel appearing on behalf of the petitioner that during course of investigation,
Patna High Court CR. MISC. No. 26754 of 2026(2) dt.27-04-2026 2/3 the alleged mobile which was used in cyber fraud was seized from the mobile repairing shop of co-accused Saurav Kumar. It is submitted that on his confession and also on the basis of single transaction of Rs. 1400/- which was made by said co-accused Saurav Kumar to this petitioner in personal capacity being neighbour, the petitioner was implicated with present crime in question, who is otherwise man of clean antecedent.
5. Learned APP opposed the prayer of bail.

In view of aforesaid factual submissions and by taking note of fact as prima facie the implication of petitioner appears on the basis of suspicion arising out of single transaction of Rs. 1400/- as discussed aforesaid, accordingly, above named petitioner, in the event of his arrest or surrender before the learned trial Court, within a period of four weeks of the order, is directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Bhagalpur/concerned Court, where the case is pending in
Patna High Court CR. MISC. No. 26754 of 2026(2) dt.27-04-2026 3/3 connection with Cyber P.S. Case No. 03 of 2026 subject to the conditions as laid down under Section 482(2) of the BNSS.
