1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Ballia P.S. Case No. 300 of 2022 dated 28.10.2022 registered for the offence(s) punishable under Section(s) 324, 307, 353/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner is a young person, he has fair and clean antecedent, he is not named in the FIR and later on during investigation, his name came into light in the re-statement of the informant but thereafter the informant filed a petition before the trial court in which he denied the role of this petitioner in the commission of the alleged occurrence

Patna High Court CR. MISC. No.28045 of 2023(2) dt.25-05-2023 2/2 and the copy of the said petition has been filed along with this petition. Further submissions are that the petitioner is a student of Intermediate having a bright educational career and he has been dragged in this case merely on suspicion and informant sustained injury accidentally from the firing made on the police party when two stolen motorcycles were being taken by the police from the village of the informant and that firing was committed by some criminals.

4. Learned APP appearing for the State opposes the bail prayer.

Considering the above submissions and mainly the petitioner's fair and clean antecedent and his academic career as well as his young age as mentioned in the petition, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Ballia P.S. Case No. 300 of 2022 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) Sanjay/- U T
