====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-04-2018 Heard learned counsel for the petitioner, counsel appearing on behalf of the State as well as counsel appearing on behalf of the South Bihar Power Distribution Company.

The petitioner apprehends his arrest in connection with Dumraon P.S. Case No.156 of 2016 registered under Sections 143, 448, 342, 353 of the Indian Penal Code and under Section 140 of the Electricity Act.

The learned counsel for the opposite party No.2 submitted that petitioner has committed offence under Section 140 of the Electricity Act where the penal liability is payment of Rs.10,000/-. He submits that petitioner and others have ransacked to the office

Patna High Court Cr.Misc. No.13875 of 2018 (2) dt.05-04-2018 2/2 of the Electricity Department and caused offence of various description of the Indian penal code as well as offence under Section 140 of the Electricity Act.

Considering the entire facts and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Dumraon P.S. Case No.156 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure, subject to the additional condition that the petitioner will deposit Rs.10,000/- in the Court below and the said deposit will abide by the final outcome of the criminal case.
