ANJANA MISHRA ORAL ORDER 17-09-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners being the father-in-law and mother-inlaw are apprehending his arrest in connection with Biddupur P.S. Case No. 40 of 2011 for the offences registered under Sections 304B/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the main accused (husband) has now been acquitted in the trial giving the benefit of doubt as it has come on record that the victim girl was in the habit of running away from her Sasural and she was also mentally disturbed.
In view of the fact that the main accused has now been acquitted, let the petitioners, above named, in the event of their
Patna High Court Cr.Misc. No.27505 of 2016 (3) dt.17-09-2016 arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Biddupur P.S. Case No. 40 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
