JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-10-2020 Heard learned counsel for the petitioners and learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in Rahika P.S. Case No. 39 of 2020 registered for the offence under Sections 304-B/34 of the Indian Penal Code.
As per the prosecution case, daughter of the informant was married to Pravakar Jha (son of petitioners) in the year 2016. It is further alleged that thereafter, daughter of the informant was subjected to cruelty and harassment for demand of dowry and on non-fulfillment of the same, in the night of 04-04-2020, victim's husband informed the informant on phone that victim is very ill and unable to recover. It is further alleged that when the informant went to matrimonial home of his daughter, he saw that accused persons were burning the dead-

It is submitted on behalf of petitioners that petitioner no. 1, who is father-in-law of deceased, is aged about 75 years and petitioner no. 2, who is mother-in-law, is aged about 65 years and they are physically disabled. There is general and omnibus allegation. Petitioners are living separately and have got no concern with the family affairs of the deceased. and have no criminal antecedent.
Considering the aforesaid facts and circumstances, the anticipatory bail application of petitioners is allowed. In the event of arrest or surrender within a period of eight weeks from the date receipt/production of copy of this order, let the abovenamed petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Shri Ashutosh Ravi, learned Judicial Magistrate 1st Class, Madhubani, in connection with Rahika P.S. Case No. 39 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
