JUSTICE PARTHA SARTHY ORAL ORDER 13-10-2020 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. The petitioner has filed the instant application for grant of anticipatory bail apprehending her arrest in connection with Jiyapokhar P.S. Case no. 8 of 2020 registered under sections 419 and 420 of the Indian Penal Code. As per allegation in the FIR, it is stated by the informant that a video had gone viral wherein the petitioner was seen taking Rs. 50/- in the name of making Rashan Card. It is submitted by learned counsel for the petitioner that the allegation against the petitioner is false and concocted.

She has been falsely implicated in the case at the instance of the informant who happens to be the son of the ex-sarpanch. The petitioner is not working in the capacity of Jivika Mitra of Bandar Jhula, ward no. 4, Doriyagaon. It is submitted that as a result of her unemployment, she used to fill-up forms and some amounts were voluntarily offered by different persons which she accepted for her livelihood. She is a female having no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner, the Court is inclined to enlarge the petitioner on anticipatory bail. The petitioner is directed to surrender in the Court below within a period of eight weeks from today and in the event of her arrest or surrender in connection with Jiyapokhar P.S. Case no. 8 of 2020 she will be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate I/C, Kishanganj subject to the condition as laid down under section 438(2) of the Cr.P.C.
