Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Aurangabad (Town) P.S. Case No. 24 of 2020, registered under Sections 379 and 411 of the Indian Penal Code. The accusation is that in course of patrolling duty, informant and other police personnel received information to the effect that in the campus of Isolation Company, which has been declared bankrupt, cement bricks were being loaded from the said campus then informant and other police personnel reached there and saw a truck bearing registration no. JH02AM-9365 was parked, on

Patna High Court CR. MISC. No.27985 of 2020(2) dt.05-02-2021 2/2 which, the cement bricks were being loaded. On query, labourers disclosed that the cement bricks are being loaded on the instruction of Contractor. At that time, driver of the said truck and Contractor were not present.

Learned counsel for the petitioner submits that petitioner is the driver of the said truck and on instruction of the Contractor, cement bricks were being loaded on the truck for fare. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (Town) P.S. Case No. 24 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
